Backup error "e0008488 - Access is denied" Windows Server SystemState

I have been getting the following error from my backups when I attempt to backup the system state for any of the servers current acting as domain controllers (I have 3) running Windows 2003 R2 32bit and Windows 2008 standard edition. I originally started getting the errors with Symantec Backup Exec v12.0 so i upgraded to the 12.5 but with the same results. The account is setup as an Administrator on the domain. I even reset the ownership of the Windows directories
I found a lot of forums online without resolutions, can anyone help?

You are not the only one. Have 3 servers: 2003 x32 R2 Ok, 2003 x64 R2 with Exchange Ok, 2008 x64 file system ok but system state with same error.

   I have 3 Win2000 servers all running Citrix Metaframe that do the same thing.
No matter what we've tried we cannot back up SysState on those 3.

  They're boat anchors that will be decommissioned soon, so what I did was to use the native backup to dump the SysState data to a .bak file and put it to tape from there.
