can you check the version of virtfile.sys in Drivers folder and compare it with the version of Virtfile.sys present in BE Install Path\Virtfile folder. ( 2.8.2068.0 is the correct version that should be in drivers folder ). If this is not the case then a debug of the Hyper V server will need to be checked ( open a case with Tech Support).

If you see the virtfile version mismatch then replace the virtfile.sys file in drivers folder with the one from backup Exec\Virtfile folder ( you will need to perform this steps by booting into the safe mode else contact tech support for assistance with this )

Are you doiong D2D2T (Disk-to-disk-to-tape)?

Yes we do D2D2T

The D2D is fine, but the weekly and monthly copy to tape gets this error.

so its not the direct backup to tape which shows this exception ? Is a direct backup tested by any chance to tape ?
If that works, then ignore my earlier response. This could be something else.
