I have a small issue and would like some advise on how to handle this legally with Veritas....
Currently I am utilizing all of the 10 remote agents and due to
a new server coming into the mix I need to start backing it up as an 11th server agent....
Now then in less than one month the old server will be going offline....
How can I approach this without stepping on too many toes?

You could remove the agent now from the server which will be going offline in a month and simply install BE as an eval copy on that machine for the next month. Use the license key for the new machine.

In doing this will I still be able to attach to this server remotely as I do now with the agents?

Yes because 9.1 installs a remote agent locally.
