I have Backup Exec 12.5 and still have maintenance on the software.  Can I upgrade for free to Backup Exec 2010?

Yes

As long as your maintenance contract is current the upgrade to 2010 would be free.  You should have been sent an invitation to ugrade when 2010 came out

(and definitely go to 2010R2.  Many fixes and improvements over 2010)

Upgraded simply on notification that 2010 R2 was out, and only after testing for a month.

You should be able to upgrade to BE 2010 . For a confirmation you can call the licensing dept to check the upgrade information.
