Is VSS requried if not using open file backups; error file read failed(13)

We have W2K3 x64 server which was having performance issues due to high CPU utilization by VSS. Windows administrators disabled the VSS service and now the backup is failing with message as below;

Error bpbrm(pid=5396) from client XXXX ERR - Unable to backup System State or Shadow Copy. Please check the state of VSS and associated Writers.INF - EXIT STATUS 69: invalid filelist specification
3/18/2011 8:04:41 AM - Warning bpbrm(pid=5396) from client XXXXX: WRN - archive bits will NOT be cleared 
3/18/2011 8:04:41 AM - Error bptm(pid=7284) socket operation failed - 10054 (at child.c.1294)     
3/18/2011 8:04:41 AM - Error bptm(pid=7284) unable to perform read from client socket, connection may have been broken
3/18/2011 8:04:42 AM - Error bpbrm(pid=5396) could not send server status message      
3/18/2011 8:04:45 AM - end writing; write time: 01:02:5

Can NBU be able to backup client with VSS disabled, I can disable the open file backups so as to not use VSS

Also the output from  vssadmin command is as follows

H:\>vssadmin list writers
vssadmin 1.1 - Volume Shadow Copy Service administrative command-line tool

H:\>vssadmin list providers
vssadmin 1.1 - Volume Shadow Copy Service administrative command-line tool
Error: Unexpected failure: The service cannot be started, either because it is d

VSS seems to be required for Shadow Copy Component backup.

Ask the Windows admins to look for VSS updates/hotfixes.

How many streams do you have running on the server at one time?

Could be its just too many at once and you might want to set the limit on the client to only 1 or 2 streams at a time.

this is set in the master server/properties/client attributes.
