getting "access is denied" when when trying to back up mailbox and public folder

Does the BE service account has a mailbox ?
And what is your exchange version ?

the TN below has a ton of different scenarios for different versions of Exchange (you don't mention your version). Take a look for your version and see if the error is referenced there.

You can also try creating a temporary account in AD, and assign it the same permissions (admin/delegate rights in Exchange) and use that as the BE service account. Run a backup of Exchange and see if this sorts it out.

The mailbox for your service account must be active and not hidden in the GAL too...

as far as i can see, there is no BE account under the mailboxs and the excahnge version is 2010.

...yes it will. You'll have support for it with the latest version.
