OK there are kind of two things to cover here
1) We have a performance issue with Windows 2008 System State backup that does not affect all customers and at this current time we believe is related to the size/number of files and hardlinks relating to the WinSXS folder - what this means is that WinSXS is obviously part of a System State backup
2) We have an Active File Exclusion built into the product that will not backup files that don't need to be backed up (such as swap files etc) but will also restrict files that should be backed up in another way (such as via the System State or using a specific agent) from being backed up as flat files from the volume - as point 1 in effect shows that WinSXS is part of the System State then I suspect it is an Active File Exclusion blocking the actual backup.
