Remote Agent behaviour differences between evaluation and licensed modes

We had Backup Exec 11d running in evaluation mode for 45 of the allowed 60 days, we've bought a license, entered the license key into software, and now Backup Exec is refusing to backup - the following message is shown in the scheduled job logs:
 
Backup - SERVERNAME
V-79-57344-3844 - The media server was unable to connect to the Remote Agent on machine SERVERNAME.
The media server will use the local agent to try to complete the operation.
License Violation
A Remote Agent for Windows Systems license is required for protecting remote servers with this edition of Backup Exec.
Please contact your vendor for information on protecting remote servers with this edition of Backup Exec.

\\SERVERNAME\SHARENAME is not authorized with this edition of the product.
When we were in evaluation mode, we made sure that the Remote Agents were not being used in trial mode by not actually installing that module on either of the servers involved, as we are aware that these are separately purchasable items, and we ticked the checkbox to let Backup Exec use "user defined selections".  The log files from the evaluation period show the following messages, though the backups did actually complete:

If the Remote Agent is a total requirement, why did the evaluation software allow the backup to complete?  If the Remote Agent is not required, how can we restore our ability to perform a simple backup of UNC shares?  There is absolutely no need for any type of Open File support.
 
The two computers involved are both Windows Server 2003 SP2.  Our client used to have Backup Exec 9 (on a totally different server) and that allowed backup of another server using UNC shares - has 11d a bug or have the licensing rules changed?

It used to work because in Eval/Demo mode there is absolutely no license checking
 
But once you went to licensed mode, Backup Exec will require a RAWS serial to connect to a serverOs machine, whether you use a RAWS or a user defined share. 
 
One of the work arounds published for NAS boxes that you cannot install software on, but run a ServerOS or Windows Emulator, is to create User Defined Shares, but it specifically says that you still need a remote agent serial installed on the media server
