Just landed in a new shop and checking out all the HW and SW, we seem to be getting some errors in BackupExec so I figured I'd start with version/release/service pack...
I am running bacdkup exec with a file version or 12.5.2213.0, is this the best version of 12.5, , if not what do I need? and can I get it free?

Thats the only version of BE 12.5...Click on Help - About - Installed Updates to see what service pack is installed...SP4 was the last pack released for this version
Post 12.5, there has been 2010, 2010 R2, 2010 R3 & 2012..If your company has an active support maintenance, you can upgrade at no cost

Installed updates says none and when I run Live Update it fails ?? now what?

If you also use other Symanetc LiveUpdate awrae applications and have configured a Live Update Adminsitaor server (central patch download server within your network) then LiveUpdate in BE might return "Unable to Find Any Updates" as such you might need to check for this kind of configuration.
Try installing the patch manually...if that doesn't work, you can try this -
Uninstall LiveUpdate from Add/Remove programs (this would remove LU if other Symantec programs are installed)
Delete the LiveUpdate folders from C:\Documents and Settings\All Users\Application Data\Symantec\
Download & install LiveUpdate 3.3 from https://www-secure.symantec.com/norton-support/jsp...
if you have other Symantec programs, you might want to opt out Backup Exec using this KB - http://www.symantec.com/docs/TECH52744
