Skipping files creats failure

If I do a backup, on any server I have, I have 50 or so...
Anytime a file is skipped for being in use... It leaves me with a failed backup.. Even though it really did complete, except for that "open" file..
Is this common for Backup Exec? And is there somewhere in setup to say, ignore skipped files, for logging??

A skipped file will not result in a FAILED status on v9.0 and later (it would on v8 and earlier, which caused a huge customer backlash which they eventuall y responeded to)
 
 
You need to look for other causes for the FAILED status

My mistake, We are running 8.6  I hit the wrong forum when posting...

So an upgrade to 9 and above would fix this??
Do you know if there are any documents out there, that show that this was a problem, that I could show my Administrators?

Forgive my failing BioRAM.  v8 introduced the completed with exceptions, so skipped files only should result in a "Completed with Exceptions" status
 
There should be some other cause for the FAILED status
