Windows Server 2003 with SP2 System State fails

Hello I have a few servers running W2k3 with SP1 and I have no issues with backing up the system state

but with a new server 2003 with SP2 the system state fails

Backup- \\INTELLEDOX\Shadow?Copy?Components \\INTELLEDOX\Shadow?Copy?Components V-79-57344-65247 - A failure occurred reading an object.

Backup- \\INTELLEDOX\Shadow?Copy?Components \\INTELLEDOX\Shadow?Copy?Components WARNING: "\\INTELLEDOX\Shadow?Copy?Components\System?State\System Files\System Files" is a corrupt f... This file cannot verify.

V-79-57344-65247 discribes how this error only occurs when a system state file is corrupt this is a fresh install of server 2003 with SP2

also I did the test which found no corrupt files
