Backup Exec fails on system state

I have a server running SBS 2008 that is suddenly failing on the System State with "A communications error has occured".. The BERS service stops, but the thing is, I'm not backing up a remote server - there's only one, and it's what BE is running on? I'm running BE 12.0 on it.. Any ideas?

...if you have an AV installed, stop and disable it and run the backup again.

If it goes through successfully, then I'd suggest you exclude the BE service files from active scanning.

Can you please paste the event from application log which shows the service crash error?

Local Backup Exec Remote agent service will come into picture for local backups.

I will paste/post it here. The odd thing is it seems (to me anyway) to be time related to the SQL backup that I have running native but according to the docs this isn't supposed to be an issue on 1010 R3. sorry about the copy/paste; is there an import or attach funciton i'm missing lol

That's the article I had found as well. Reading this though I thought this issue was supposed to be resolved in 2010 R3?  Just curious
