Backup version 9 corruption errors on Windows 2008 Server

I know I am running an older version of Backup Exec for Windows, but...  We recently upgraded our file server to Windows Server 2008, and our backup utility stayed at version 9.  After the upgrade of the file server, backup exec is generating errors of "Access denied to file ......path), and the Backup Set Detail Information is identifying the fileswith "Warning: ... (File path) is a corrupt file."

I am almost certain these files are open by users during backup.  I have changed the Lock Option on the backup job to specify NEVER, and I have plugged the reg key [HKLM]Software\Veritas\Backup Exec\Engine\Backup\Fail Jobs on Corrupt Files to 0 (off), but my problem persists.  Anyone have any idea what can be done to alleviate this issue?

v9.x does not support  W2K8

W2K3 is as high as it goes

Looks like you need to beatup on your financial folks and upgrade BackupExec
