First issue seems to be a known issue:

As noted in the technote, you will have to contact Symantec for more troubleshooting.

Second error seems also to be a known issue in BE 2010 & BE 2010 R2, maybe it is still in R3 (SP1).
You can try to implement the suggested change:

My jobs are already set to modified time and not archive bit.  ??

Tech support looked at my issue yesterday afternoon.  It is still not resolved.

I assume they still have your case opened, and they will try to assist you again in solving this issue ?

What have they done/tried ?
