Backup Exec 12.5 SP4 and VSS

I have a Windows Server 2003 R2 running Backup Exe 12.5 SP4 and hotfix installed. I am using Remote Agent to perform a backup of a Windows Server 2008 (FileServer2). I have multiple volumes being backed up on FileServer2, which one includes a 10TB (H:), 3TB plus other multiple smaller volumes. On the 10TB and 3TB volume, I have Shadow Copy enabled and have a scheduled task run 3 times throughout the day to do shadow copies. The Shadow Copy works perfectly fine on both volumes until a Backup is ran. At that point the Shadow Copy on the 10TB volume no longer works and when I try to manually do a shadow copy, I get the following message box "Failed to create a shadow copy of volume H:\.  Error 0x8007000e: Not enough storage is available to complete this operation."

During the scheduled task, it also fails to do the shadow copy and the following is logged into the event viewer:

The previous shadow copies also are wiped clean from the list. Now this is ONLY on the 10 TB volume it is causing the issues. The 3TB volume runs shadow copies just perfecty fine without any issues even after a backup is ran. If there is no backup done, the shadow copies work perfectly fine on the 10TB volume. After the backup is done, I do get the following exception on the backup job:

Backup- \\FileServer2\G:  - AOFO: Initialization failure on: "\\FileServer2\H:". Advanced Open File Option used: Microsoft Volume Shadow Copy Service (VSS).
V-79-10000-11217 - VSS Snapshot error. The Microsoft Volume Shadow Copy Service (VSS) snapshot failed. Make sure that all provider services and tasks are running. Check the Windows Event Viewer for details.

Any suggestions or ideas on how to fix my issue?  If this is not fixable in 12.5, would upgrading to 2010 help with it?

Here is the vssadmin list writers; everything is stable and no errors.

This is definately being caused by Back Up Exec...does anyone have any suggestions?
