Domain Controller Backup - NtFRS PreInstall Directory

Using BK Exec 2010 SP3 I ALWAYS get the following error with my Domain Controller backups. (On all 4 DCs)

I have tried putting an exclusion for this directory but it still fails, can anyone help with this please?

\\server\C:\Windows\SYSVOL\sysvol\midland-software.co.uk\DO_NOT_REMOVE_NtFrs_PreInstall_Directory

I am running BKEX2010 R3, this document states:

Solution:

This issue has been resolved in Backup Exec 11d and above.
 

However, I tried this and it does NOT work/ solve the problem.
