Delete Unreviewed items

I have a case in DA that has unreviewed items, can I detete these?

Do you mean can you delete the case?  Yes, as long as your account has permission to do so.

Or do you mean actually delete the items in EV?  As long as a Legal Hold has not been applied to the case you can delete items.  If you do that you should delete the case as the items will not be present in EV any longer.
